Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Motimi (operated by Bizvouch LLC, 1450 Justin Road, Lewisville, TX 75077, USA)("Motimi", "we", "us") governing your use of the Motimi website and app (the "Service"). Please read them carefully. By creating an account or using the Service, you accept these Terms.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) and able to form a binding contract. By using the Service you confirm you meet these requirements.
2. What Motimi is — and is not
Motimi is a personal daily growth journal. It is not a medical device, mental health treatment, therapy, diagnosis tool, or crisis support service. If you are in crisis or need professional help, contact a qualified provider or your local emergency services. Nothing in the Service constitutes medical, legal, or financial advice.
3. Your account
You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately at hello@getmotimi.com if you suspect unauthorized access. We may require email verification or two-factor authentication for security-sensitive actions.
4. Subscriptions, free trial, and billing
- Plans: Motimi+ is offered on a monthly ($6.99/mo) or annual ($39/yr) basis. Prices may change with at least 30 days' notice for the next billing cycle.
- Free trial: New subscribers may receive a 7-day free trial. A valid payment method is required. Unless you cancel before the trial ends, your subscription will automatically start and your card will be charged the then-current price.
- Auto-renewal: Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel any time from the Me page or the Stripe customer portal.
- Refunds: See our Refund & Subscription Policy, including the 14-day EU/UK statutory withdrawal right.
- Taxes: Prices are exclusive of any applicable taxes, which will be added at checkout where required.
5. Your content
You retain all rights to the content you create in Motimi. By storing it on our Service, you grant us a limited, worldwide, royalty-free license to host, store, back up, transmit, and display your content solely as needed to operate the Service for you. We never sell your content, never use it for advertising, and never use it to train third-party AI models.
You are responsible for the legality of what you write. You confirm you have the right to share any content you upload (including names of other people you mention).
6. Acceptable use
You agree to follow our Acceptable Use Policy. In short: don't use Motimi for anything illegal, don't attempt to break or interfere with the Service, and don't use it to harm others.
7. Intellectual property
The Motimi name, logo, software, design, and content (other than user-generated content) are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a personal, non-transferable, revocable license to use the Service while you have an active account.
8. Copyright complaints (DMCA)
If you believe content on Motimi infringes your copyright, please follow the procedure in our DMCA Policy.
9. Service availability and changes
We work hard to keep Motimi reliable but we do not guarantee uninterrupted or error-free service. We may update, change, or discontinue features at any time. If we discontinue a paid feature, we will offer a pro-rated refund for the unused portion.
10. Termination
You can delete your account at any time from the app. We may suspend or terminate accounts that violate these Terms, our Acceptable Use Policy, or applicable law. On termination your data will be handled as described in our Privacy Policy.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and"as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your expectations or be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, this section applies to the maximum extent permitted.
12. Limitation of liability
To the fullest extent permitted by law, in no event will Motimi, its affiliates, directors, or employees be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or any consumer rights you have under EU/UK or other mandatory law.
13. Indemnity
You agree to indemnify and hold Motimi harmless from any claims arising from your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of State of Texas, United States, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction. If you are a consumer in the EU/UK, you may also bring proceedings in your country of residence and benefit from the mandatory consumer rights of that country. EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will notify you inside the app or by email at least 14 days before they take effect. Continued use of the Service after that date means you accept the updated Terms.
16. Miscellaneous
These Terms together with the Privacy Policy and other referenced policies form the entire agreement between you and Motimi. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
